General Terms and Conditions (GTC)

 

1 Scope and provider

(1) These Terms of Use govern the use of our direct booking and reservation website at https://apartments.guestywebsites.com/ (hereinafter referred to as "Website" or "Service"). (2) The provider and contracting party is: SuccessMill GmbH, Neuenreuth 11, 95336 Mainleus, Germany - Telephone: 49 151 58967990 - Email: info@success-mill.com (3) These Terms and Conditions apply to all visitors and users of the Website who submit a reservation request for our holiday apartments, regardless of whether they are private individuals or corporate clients.


2 Definitions

"We," "us," or "provider": SuccessMill GmbH. "You" or "user": The natural or legal person who accesses the website or submits a reservation request through the website. "Service" or "website": The online platform we provide through which reservation requests can be submitted. "Device": Any device that can be used to access the service (e.g., computer, smartphone, tablet).


3. Acceptance of the Terms and Conditions

(1) By accessing or using the service, you acknowledge these terms and conditions as binding. If you do not agree to these terms and conditions, you may not use the service.

(2) You confirm that you are at least 18 years old and have full legal capacity. Persons under 18 years of age are not permitted to use the service.

(3) Use of the service also requires that you have read and understood our privacy policy.


4 Function of the service (reservations)

(1) You can submit a non-binding reservation request for our holiday apartments via this service. A binding rental or accommodation contract is not concluded simply by submitting the request form, but only upon our separate confirmation (e.g., by email) or by signing a corresponding contract.

(2) Unless expressly stated otherwise, the accommodations, prices and availability shown in the service are subject to change without notice and do not constitute a legally binding offer.

(3) We reserve the right to refuse reservation requests in individual cases, in particular in the event of lack of availability, incomplete information or in the event of justified suspicion of misuse.


5. Contract conclusion and information obligations in electronic business transactions

(1) You can submit a reservation request for your desired holiday apartment via the booking engine on our website. Before you finalize your request, your entries (including travel dates, number of guests, and contact details) will be displayed in an overview where you can review and correct them before submitting.

(2) By submitting your request, it will be received by us and stored in our booking system for further processing. For inquiries submitted via our general contact form (e.g., general inquiries or job applications), you will also automatically receive a copy of your information at the email address we have on file.

(3) A rental agreement for the holiday apartment, as described in section 4, is only concluded upon our separate confirmation. This confirmation is sent individually by email. We do not currently send an automated confirmation of receipt for reservation requests; this does not affect the validity of your request.

(4) We will send you the essential contract details (booking confirmation) by email as part of the confirmation; you can save and print this. You can access, download, and save these Terms and Conditions at any time on our website.

(5) The language of the contract is German.


6. Prices, Payment and Additional Costs

(1) The prices displayed on the website are non-binding guidelines and are subject to dynamic, daily price changes. The total price shown in the respective booking confirmation is binding.

(2) We do not charge any additional booking fees for submitting a reservation request via our website.

(3) Unless otherwise agreed in individual cases, the total amount is due for payment within 14 days of receipt of the booking confirmation.

(4) In addition to the rental price, a final cleaning fee will be charged. The amount of this fee depends on the size of the apartment and the length of stay and will be shown separately in the booking confirmation.

(5) For the holiday apartment "Juraperle" in Bad Staffelstein, we additionally charge the municipal tourist tax of the town of Bad Staffelstein as follows: Adults aged 18 and over: €2.50 per person per night; young people aged 14 to 18: €1.75 per person per night; children under 14 are exempt from tourist tax. Business travelers are exempt from the tourist tax. The currently valid tourist tax regulations of the town of Bad Staffelstein apply.

(6) The conditions for cancellations are set out in the separate cancellation policy published on our website, which will form part of the respective accommodation contract.


7. No right of withdrawal for accommodation contracts

Contracts for the provision of accommodation for purposes other than residential purposes (accommodation contracts) are excluded from the statutory right of withdrawal for consumers in accordance with Section 312g Paragraph 2 No. 9 of the German Civil Code (BGB). Therefore, you do not have a right of withdrawal when booking our holiday apartments.


8 User Obligations

(1) You are required to provide truthful, current, and complete information when making a reservation request (in particular, your name, contact details, and the number and type of accompanying persons). (2) You may not use the service in a manner that violates applicable law or the rights of third parties or impairs the operation of the website. This includes, in particular: a) the transmission of illegal content, b) the use of automated systems (e.g., bots) for mass queries, c) attempting to gain unauthorized access to systems or data. (3) You are required to keep access data and key codes for entering the apartments (if provided to you) confidential and to protect them from unauthorized access by third parties.


9 links to external websites

(1) The service may contain links to third-party websites or services (e.g., Airbnb, Booking.com, Google Maps). We have no control over the content, availability, or terms and conditions of these third-party services. (2) We assume no responsibility for the content, privacy practices, or terms of use of such third-party services. Use of these services is at the user's own risk. (3) We recommend carefully reading the applicable terms of use and privacy policies of the linked third-party providers.


10 Termination and blocking of use

(1) We are entitled to temporarily or permanently block access to the service, in whole or in part, if a user violates these Terms and Conditions or if there is a concrete risk of such a violation. (2) In the event of termination or blocking, the right to use the service expires with immediate effect. Contracts for accommodation services already concluded remain unaffected.


11 Liability

(1) We are liable without limitation for damages resulting from injury to life, body, or health caused by our intentional or negligent breach of duty. (2) For other damages, we are liable without limitation only in cases of intent or gross negligence. In cases of simple negligence, we are liable only for breaches of a material contractual obligation (cardinal obligation), limited to the foreseeable damages typical for this type of contract. (3) A material contractual obligation is an obligation whose fulfillment is essential for the proper performance of the contract and on whose compliance the user may regularly rely. (4) The limitations of liability do not apply to the extent that we have assumed a guarantee or are liable under mandatory statutory provisions (e.g., the Product Liability Act).


12 Warranty and Availability

(1) We strive to provide the service with as little interruption as possible. However, temporary restrictions may occur, particularly for technical reasons (e.g., maintenance, security). There is no entitlement to uninterrupted availability. (2) The service is provided in the form that is available at the time of service. We do not guarantee that the service will meet specific user requirements or be compatible with all end devices.


13 Applicable Law and Dispute Resolution

(1) The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). (2) If the user is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes shall be our registered office in Mainleus. (3) In relation to consumers, the statutory rules of jurisdiction shall apply. (4) We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.


14 Severability Clause

(1) Should any provision of these Terms and Conditions be or become wholly or partially invalid or unenforceable, this shall not affect the validity of the remaining provisions. (2) The invalid provision shall be replaced by a valid provision that most closely approximates the economic purpose of the invalid provision.


15 Changes to these Terms and Conditions

(1) We may amend or supplement these Terms and Conditions at any time with future effect, insofar as this is necessary due to legal changes, the further development of the service, or existing regulatory gaps. (2) The version of these Terms and Conditions published on the website at the time of your respective reservation request or use of the service shall always apply. (3) For bookings already confirmed and existing accommodation contracts, the Terms and Conditions in the version valid at the time of conclusion of the contract shall continue to apply; subsequent amendments shall not affect them.
